Terms of Use

1.1

This Agreement to access the terms of use policy for the grade-university.com website (hereinafter referred to as the "Agreement") regulates the relationship between the Developer of the grade-university.com website (hereinafter referred to as the "Developer") and the Individual who has expressed a desire to use this website and has duly joined this Agreements (hereinafter - the "User") to obtain the right to use the grade-university.com website (hereinafter - the website) under the conditions defined below.

1.2

This Agreement shall enter into force on August 18, 2022.

1.3

Definition:

• 1.3.1

  The "grade-university.com website" is a collection of web pages and related content available on the Internet, which are combined both in terms of content and navigation under a single domain name - grade-university.com.

• 1.3.2

  The "Developer" is considered a legal entity — GRADE ASSESSMENT Limited Liability Company, legal address: office 18, letter B, building 13/2, Yaroslaviv Val str., Kyiv, 01054, Ukraine.

• 1.3.3

  The "User" of the grade-university.com website is any individual who has ever accessed/used the grade-university.com website and is of legal age to accept this Agreement, in accordance with the provisions of the law.

• 1.3.4

  "Educational course" is a complex of electronic educational and methodical materials created for the organization of self-study using distance technologies based on Internet technologies.

• 1.3.5

  "Video library" is a distributed information system that allows you to store and use heterogeneous collections of video materials for learning using distance technologies based on Internet technologies.

• 1.3.6

  Other.

1.4

This Agreement is an open and publicly available document containing all essential terms and is a public offer to all interested parties.

• 1.4.1

  The Developer reserves the right to deny access to the grade-university.com website, the use of Training Courses and the Video Library to natural persons — citizens of the Russian Federation for the reasons of preserving the reputational, national and moral interests of the citizens of Ukraine.

1.5

The User accepts this Agreement (that is, gives his/her direct and irrevocable consent to comply with all the terms of this Agreement) by performing at least one of the following actions:

• 1.5.1

  use of any of the functions (functionality) and/or services of the grade-university.com website;

• 1.5.2

  registration on the grade-university.com website;

• 1.5.3

  and/or instructions "I have read and agree to the Terms of use" when using the website.

1.6

Accepting the terms of this Agreement, in accordance with Clause 1.4. of this Agreement, the User confirms that he/she is fully and completely familiarized with, agrees and accepts the terms of the Agreement in full, without any reservations and exceptions, and gives his/her consent to the processing of his/her data by the Developer, including personal data entered by the User when using the grade-university.com website.

1.7

The procedure for processing personal data, the types of personal data that are collected, the purposes of using such personal data, interaction with third parties, the rights of the subject of personal data are set out in the Privacy Policy at the address: https://grade-university.com/privacy-policy

1.8

In accordance with Articles 633 and 634 of the Civil Code of Ukraine, this Agreement is a public contract of accession. The Developer grants the User the right to access and use the grade-university.com website under the terms of this Agreement.

1.9

This Agreement may be amended and/or supplemented by the Developer unilaterally, without any separate and/or special notice. At the same time, continued use of the grade-university.com website after making changes and/or additions to this Agreement means the User's consent to such changes and/or additions.

1.10

Applications, suggestions and claims of the User to the Developer related to the functioning of the grade-university.com website can be sent to the e-mail address: support@grade.university.

1.11

By accepting the terms of this Agreement, the User confirms his/her right and legal capacity, confirms the authenticity of his/her personal data (personal information) and assumes full responsibility for their accuracy, completeness and reliability.

1.12

The User assumes all possible risks, including material risks, related to his/her actions in using the grade-university.com website.

1.13

The grade-university.com website is provided on an "as it is" basis. The Developer is not responsible for any unauthorized access or use of functions or services of the grade-university.com website and/or any information stored on them about the User, as well as for any errors, failures, viruses and other defects and violations in the work of the grade-university.com website, which may be transferred to the grade-university.com website or through the grade-university.com website by third parties and their consequences for the User, including, but not limited to: real damage, lost profit, damages, moral damage, damage to honor, dignity and business reputation.

1.14

When using any of the functions or services of the grade-university.com website, the User undertakes to comply with the rules and restrictions set forth in this Agreement.

1.15

The Developer undertakes to make every effort to properly fulfill its obligations under this Agreement, including the normal operation of grade-university.com website services, as well as not to distribute to third parties the personal data provided by the User, except for cases provided for by law or this Agreement.

2.1

The Developer has the right to transfer the rights and obligations under this Agreement, including the grade-university.com website with all its services and content, including the User's personal data (personal information), to third parties for the purpose of fulfilling this Agreement without separate and/or additional consent of the User.

2.2

The Developer has the right to disclose personal data without the User's consent in the cases determined by law and in the interests of national security, economic well-being and human rights, in particular, but not exclusively, upon justified requests of government bodies that have the right to request and receive such data and information.

2.3

The Developer has the right to send the User information about the operation of the grade-university.com website in any way, including sending advertising, informational and other messages to the e-mail address or phone number specified by the User, or to post relevant information on the grade-university.com website itself.

2.4

The Developer provides the User with the opportunity, both free of charge and for a fee in specified amounts, to take Training Courses and/or view the materials of the Video Library, as well as to use the full functionality/services of the grade-university.com website.

2.5

In order to ensure the best level of service, the Developer reserves the right to interrupt the operation of the grade-university.com website for maintenance, system updates or any other changes, informing the Users accordingly.

2.6

Within the limits of the law, the Developer may also decide to suspend or completely terminate the provision of services. If the grade-university.com website is terminated, the Developer will cooperate with Users to allow them to remove personal data or information in accordance with applicable law.

2.7

The work of the grade-university.com website may also be unavailable due to reasons beyond the Developer's control, such as force majeure.

2.8

The Developer has the right to block the User's access to the grade-university.com website or its parts in the event that the User detects violations of this Agreement.

2.9

The Developer has the right, subject to Clause 2.11 and Section 4 of this Agreement, to process the User's personal data within the limits and in the manner determined by this Agreement.

2.10

The Developer has the right, without separate and/or prior notice, to limit, suspend or terminate the use of the grade-university.com website without compensating the User for the damages incurred, including if the Developer has data to believe that the User or its affiliates (intentionally or unintentionally):

• when using the grade-university.com website, violate the current legislation, the provisions of this Agreement or the rights and legitimate interests of third parties;
• use the grade-university.com website in bad faith, excessively or not in accordance with its purpose;
• cause damage to the grade-university.com website or its functionality;
• attempt to gain unauthorized access to the grade-university.com website and the information contained therein;
• create a threat of technical and/or software failure of the Developer and/or third parties.

2.11

The Developer has the right, without prior notice, to limit, suspend or terminate the possibility of using the grade-university.com website in the event of a corresponding decision of the state or other authorized body, or in other cases provided for by the current legislation of Ukraine and international rules/laws.

2.12

All information and materials or the entire content of the grade-university.com website, including design elements, texts, graphic images, photos, videos and others, which do not belong to third parties, are the objects of the exclusive rights of the Developer and are protected by copyright, trademark and other laws protecting intellectual property. No information and/or materials posted on the grade-university.com website may be reproduced, adapted, distributed, published, transferred, or sold, in whole or in part, without the prior permission of the Developer.

3.1

The User undertakes to properly comply with the terms of this Agreement.

3.2

The User has the right to use the grade-university.com website exclusively for the purpose of personal use in accordance with the terms of this Agreement.

3.3

The User undertakes not to use the grade-university.com website in violation of the rights and legitimate interests (including, but not limited to, copyright and related rights, as well as other property and non-property rights of subjects of intellectual property rights) of the Developer, other rights holders, third parties and this Agreement.

3.4

The User is prohibited to modify, copy, distribute, republish, upload, post, decompile or transmit in any way, independently or with the involvement of third parties, the content, web pages or any information posted on the grade-university.com website without the prior written consent of the Developer.

3.5

The User bears personal responsibility for using the grade-university.com website in any way not expressly permitted by this Agreement and/or the law.

3.6

The User has no right to perform any unauthorized actions regarding the operation of the grade-university.com website.

3.7

The User is given the opportunity both for free and for a fee in specified amounts, to take Educational Courses and/or view the materials of the Video Library, as well as to use the full functionality/services of the grade-university.com website.

3.8

The terms of use of the grade-university.com website may be changed and/or supplemented by the Developer unilaterally. At the same time, continuing to use the grade-university.com website after making changes and/or such additions means the User's consent to such changes and/or additions.

3.9

The User certifies, by joining the terms of the Agreement (in accordance with Clause 1.4.), that he/she knows (and is aware of the fact) about the inclusion of personal data (personal information) in the personal database for the purpose of implementing this Agreement, ensuring the functioning of the grade-university.com website and implementation of the rights and obligations defined by law in the field of implementation of this Agreement, and also received information about his/her rights, defined by the Law of Ukraine "On the Protection of Personal Data", and about the persons to whom his/her data is provided, for the fulfillment of the specified purpose. Sufficient notification of the User about the inclusion of his/her personal data in the database will be confirmation of the User's registration, or the fact of the actions provided for in Clause 1.4. of this Agreement.

3.10

The User gives consent to the Developer to process his/her personal data for the implementation of this Agreement, the Developer's ability/ensuring the functioning of the grade-university.com website, improvement of the service and collection of market statistics.

3.11

The User does not have the right to post information (data), use the grade-university.com website, if he/she does not agree with the terms of this Agreement, or if he/she has not reached the legal age from which he/she has the right to enter into transactions of this type in accordance with the law. In this case, the Developer proposes to terminate access and/or use of the grade-university.com website.

4.1

Third parties may be involved in the execution of this Agreement. The User confirms that the specified third parties are granted the same rights as the owner of the rights to use the grade-university.com website, including in relation to the User's personal data.

• 4.1.1

  The responsibility for money transfers made by the User in connection with the use of the grade-university.com website lies with the banks, financial institutions, payment systems, etc., through which such transfers are made. The developer is not responsible for the actions of the processing centers.

4.2

The User guarantees that he/she will not take any actions aimed solely at causing harm to the Developer, rights holders or other persons.

4.3

In case of violation of the rules of use of the grade-university.com website, User's obligations and prohibitions specified in this Agreement, as well as in case of violation of Clause 5.2 of this Agreement, the User undertakes to compensate the Developer's losses caused by such actions in full.

4.4

In the event of fines being imposed on the Developer in connection with the presentation by third parties of claims related to the Information published by the User and/or the User's violation of rights to intellectual property objects, the User undertakes to compensate the Developer for all damages, including legal costs caused by non-compliance with the provisions of this Agreement or violation of the rights of third parties.

4.5

The User bears full personal responsibility for unauthorized third-party access to the grade-university.com website accessed through the User's devices.

4.6

In case of loss, deletion, damage of information entered by the User when using the grade-university.com website as a result of the User's actions/inaction, the User bears all responsibility.

4.7

Recognizing the international nature of the Internet, the User assumes responsibility for compliance with all local rules and laws (where the User has access to and uses the grade-university.com website) related to the User's actions on the Internet.

In the event that the use of the grade-university.com website is contrary to local rules and laws, the Developer proposes to stop accessing and/or using the grade-university.com website.

4.8

The User of the grade-university.com website undertakes not to perform actions that may be considered as a violation of Ukrainian legislation or international law, including in the field of intellectual property, copyright and/or related rights, as well as any actions that lead or may lead to to disruption of the normal operation of the grade-university.com website.

4.9

The Developer is not responsible for the information (personal data) that the User posted when using the grade-university.com website.

4.10

Due to the fact that the grade-university.com website operates via the Internet, the Developer disclaims responsibility for:

• any violations of the grade-university.com website;
• any errors in the work of the grade-university.com website;
• causing damage, loss of information or various other harm to persons that occurred when using the functionality and services of the grade-university.com website, including any other material losses incurred as a result of visiting the grade-university.com website or the impossibility of visiting it;
• violation by the User of copyright (related rights, as well as other property and non-property rights of subjects of intellectual property rights) and other rights of third parties, by providing information (data) inconsistent with the current legislation (including legislation regulating relations in the field of intellectual property, both Ukrainian and international legislation), including those provided by the User when using the grade-university.com website;
• posting of information by criminals, namely the posting of information with deliberately false data.

5.1

The place of service provision is Ukraine. In the event of any disputes or disagreements related to the implementation of this Agreement, the User and the Developer will make every effort to resolve them through negotiations between them. If any disputes, disagreements or claims arising out of or in connection with this Agreement, including those relating to its performance, breach, termination or invalidity, cannot be resolved by negotiation, then these disputes shall be resolved in judicial procedure in accordance with the current legislation of Ukraine at the location of the Developer.

All possible disputes arising from the relations regulated by this Agreement shall be resolved in accordance with the procedure established by the legislation of Ukraine, according to the norms of Ukrainian law.

Everywhere in the text of this Agreement, unless clearly stated otherwise, the term "applicable legislation" means the applicable legislation of Ukraine.

5.2

None of the Parties to the Agreement shall be liable for non-fulfillment or improper fulfillment of obligations under this Agreement, if proper fulfillment was impossible due to force majeure.

5.3

This Agreement enters into force for the User from the moment of visiting the grade-university.com website or performing the actions provided for in Clause 1.4. of this Agreement and is valid indefinitely, during the entire period of use of the grade-university.com website by the User.

5.4

This Agreement is drawn up in Ukrainian, however, it is additionally provided for review by the User in English translation. In case of inconsistency between the terms of this document in Ukrainian and its translation into English, only the version in Ukrainian shall have legal force.

5.5

If any provision of this Agreement is held invalid, this shall not affect the validity or enforceability of the other provisions of this Agreement.

1.1

Ця Угода на приєднання до політики умов використання вебсайту grade-university.com (надалі — «Угода») регламентує відносини між Розробником вебсайту grade-university.com (надалі — «Розробник») і Фізичною особою, яка виявила бажання використання цього вебсайту та належним чином приєдналася до цієї Угоди (надалі — «Користувач») для отримання права використання вебсайту grade-university.com (надалі — вебсайт) на визначених нижче умовах.

1.2

Ця Угода вступає в силу з 18 серпня 2022 року.

1.3

Визначення:

• 1.3.1

  «Вебсайт grade-university.com» — це сукупність вебсторінок та залежного вмісту, доступних у мережі Інтернет, які об’єднані як за змістом, так і за навігацією під єдиним доменним ім’ям — grade-university.com.

• 1.3.2

  «Розробник» вважається юридична особа — Товариство з обмеженою відповідальністю «ГРЕЙД ЕСЕСМЕНТ», юридична адреса: Україна, 01054, місто Київ, вулиця Ярославів Вал, будинок 13/2, літера Б, офіс 18.

• 1.3.3

  «Користувачем» вебсайту grade-university.com вважається будь-яка фізична особа, яка коли-небудь здійснювала доступ до/використання вебсайту grade-university.com та досягла віку допустимого для акцепту цієї Угоди, відповідно до положень законодавства.

• 1.3.4

  «Навчальний курс» — це комплекс електронних навчально-методичних матеріалів, створених для організації самостійного навчання з використанням дистанційних технологій, що базуються на Інтернет-технологіях.

• 1.3.5

  «Відео бібліотека» — це розподілена інформаційна система, що дозволяє зберігати і використовувати різнорідні колекції відеоматеріалів для навчання з використанням дистанційних технологій, що базуються на Інтернет-технологіях.

• 1.3.6

  інші.

1.4

Ця Угода є відкритим і загальнодоступним документом, що містить всі істотні умови та є публічною пропозицією (офертою) для усіх зацікавлених осіб.

• 1.4.1

  Розробник залишає за собою право відмовити у доступі до вебсайту grade-university.com, використанні Навчальних курсів та Відео бібліотеки фізичним особам — громадянам російської федерації з мотивів збереження репутаційних, національних та моральних інтересів громадян України.

1.5

Користувач приймає цю Угоду (тобто дає свою пряму та безвідкличну згоду на дотримання всіх умов цієї Угоди), шляхом виконання хоча б однієї із наступних дій:

• 1.5.1

  використання будь-якої з функцій (функціоналу) та/або сервісів вебсайту grade-university.com;

• 1.5.2

  здійснення реєстрації на вебсайті grade-university.com;

• 1.5.3

  та/або вказівки «Ознайомлений і погоджуюсь з умовами використання (Terms of Use)» при використанні вебсайту.

1.6

Приймаючи умови цієї Угоди, згідно з п. 1.4. цієї Угоди, Користувач підтверджує, що цілком і повністю ознайомлений, згоден і прийняв умови Угоди в повному обсязі, без будь-яких застережень і винятків, та дає свою згоду на обробку Розробником його даних, в тому числі персональних, внесених Користувачем при використанні вебсайту grade-university.com.

1.7

Порядок здійснення обробки персональних даних, види персональних даних, які збираються, цілі використання таких персональних даних, взаємодія з третіми особами, права суб'єкта персональних даних викладено у Політиці конфіденційності за адресою: https://grade-university.com/privacy-policy

1.8

Відповідно до статей 633, 634 Цивільного кодексу України, дана Угода є публічним договором приєднання. Розробник надає Користувачеві права доступу і використання вебсайту grade-university.com на умовах цієї Угоди.

1.9

Ця Угода може бути змінена та/або доповнена Розробником в односторонньому порядку, без будь-якого окремого та/або спеціального повідомлення. При цьому продовження використання вебсайту grade-university.com після внесення змін і/або доповнень до цієї Угоди, означає згоду Користувача з такими змінами та/або доповненнями.

1.10

Звернення, пропозиції і претензії Користувача до Розробника, пов’язані з функціонуванням вебсайту grade-university.com, можуть бути спрямовані на адресу електронної пошти: support@grade.university.

1.11

Приймаючи умови цієї Угоди, Користувач підтверджує свої право- і дієздатність, підтверджує достовірність своїх персональних даних (особистої інформації) та приймає на себе всю відповідальність за їх точність, повноту і достовірність.

1.12

Користувач приймає на себе всі можливі ризики, в тому числі матеріальні, пов’язані з його діями по використанню вебсайту grade-university.com.

1.13

Вебсайт grade-university.com надається в користування за принципом «як є». Розробник не несе відповідальності за будь-який несанкціонований доступ або використання функцій або сервісів вебсайту grade-university.com та/або будь-якої інформації, що на них зберігається про Користувача, а також за будь-які помилки, збої, віруси і інші недоліки та порушення в роботі вебсайту grade-university.com, які можуть бути передані на вебсайт grade-university.com, або через вебсайт grade-university.com третіми особами і їх наслідки у Користувача, в тому числі, але не виключно: за реальний збиток, упущену вигоду, збитки, моральну шкоду, шкоду честі, гідності та ділової репутації.

1.14

При використанні будь-якої з функцій або сервісів вебсайту grade-university.com, Користувач зобов’язується підпорядковуватися правилам і обмеженням, викладеним в даній Угоді.

1.15

Розробник зобов’язується докладати всіх зусиль для належного виконання своїх обов’язків за цією Угодою, включно нормальної роботи сервісів вебсайту grade-university.com, а також нерозповсюдження третім особам персональних даних, наданих Користувачем, за винятком випадків, передбачених законодавством або цією Угодою.

2.1

Розробник має право передавати права та обов’язки за цією Угодою, в тому числі вебсайт grade-university.com зі всіма його сервісами й змістом, включаючи персональні дані (особисту інформацію) Користувача, третім особам в цілях виконання цієї Угоди без окремої та/або додаткової згоди Користувача.

2.2

Розробник має право розкривати персональні дані без згоди Користувача у випадках, визначених законом, і в інтересах національної безпеки, економічного добробуту та прав людини, зокрема але не виключно — за обґрунтованими запитами державних органів, які мають право вимагати і одержувати такі дані та інформацію.

2.3

Розробник має право направляти Користувачеві будь-яким способом інформацію про функціонування вебсайту grade-university.com, в тому числі направляти рекламні, інформаційні та інші повідомлення на адресу електронної пошти або номер телефону, вказані Користувачем, або розміщувати відповідну інформацію на самому вебсайті grade-university.com.

2.4

Розробник надає Користувачу можливість як безкоштовно, так і за плату у визначених розмірах, проходити Навчальні курси та/або переглядати матеріали Відео бібліотеки, а також користуватися повним функціоналом/сервісами вебсайту grade-university.com.

2.5

Щоб забезпечити найкращий рівень обслуговування, Розробник залишає за собою право переривати роботу вебсайту grade-university.com для технічного обслуговування, оновлення системи або будь-яких інших змін, проінформуючи про це Користувачів належним чином.

2.6

В межах закону Розробник також може прийняти рішення про призупинення або повне припинення надання послуг. Якщо роботу вебсайту grade-university.com буде припинено, Розробник співпрацюватиме з Користувачами, щоб дозволити їм вилучити персональні дані або інформацію відповідно до чинного законодавства.

2.7

Робота вебсайту grade-university.com також може бути недоступною через причини, які не залежать від Розробника, наприклад, форс-мажорні обставини.

2.8

Розробник має право заблокувати доступ Користувача до вебсайту grade-university.com або його частини в разі виявлення порушень Користувачем цієї Угоди.

2.9

Розробник має право, з урахуванням пункту 2.11. та розділу 4 цієї Угоди, здійснювати обробку персональних даних Користувача в межах та у спосіб визначений цією Угодою.

2.10

Розробник має право без окремого та/або попереднього повідомлення обмежити, призупинити або припинити користування вебсайтом grade-university.com без відшкодування Користувачеві понесених збитків, в тому числі в разі, якщо у Розробника є дані вважати, що Користувач або його афілійовані особи (навмисно чи ненавмисно):

• при користуванні вебсайту grade-university.com порушують чинне законодавство, положення цієї Угоди або права і законні інтереси третіх осіб;
• користуються вебсайтом grade-university.com недобросовісно, надмірно або не у відповідності до його призначення;
• завдають шкоди вебсайту grade-university.com або його працездатності;
• здійснюють спроби несанкціонованого доступу до вебсайту grade-university.com та інформації яка міститься в ньому;
• створюють загрозу збою технічних і/або програмних засобів Розробника і/або третіх осіб.

2.11

Розробник має право без попереднього повідомлення обмежити, призупинити або припинити можливість користування вебсайтом grade-university.com в разі прийняття відповідного рішення державного чи іншого уповноваженого органу, або в інших випадках передбачених чинним законодавством України та міжнародними правилами/законами.

2.12

Вся інформація та матеріали або весь вміст вебсайту grade-university.com, в тому числі елементи дизайну, тексти, графічні зображення, фото, відео та інше, які не належать третім особам, є об’єктами виняткових прав Розробника і захищені законодавством про авторське право, торгову марку та іншими законами, що захищають інтелектуальну власність. Ніяка інформація та/або матеріали, розміщені на вебсайті grade-university.com, не можуть бути відтворені, перероблені, поширені, опубліковані, передані, або продані, цілком або частинами, без попереднього дозволу Розробника.

3.1

Користувач зобов’язується належним чином дотримуватися умов цієї Угоди.

3.2

Користувач має право використання вебсайту grade-university.com виключно з метою особистого використання відповідно до умов цієї Угоди.

3.3

Користувач зобов’язується не використовувати вебсайт grade-university.com в порушення прав і законних інтересів (в тому числі, але не виключно авторських та суміжних прав, а також, інших, майнових і немайнових прав суб’єктів права інтелектуальної власності) Розробника, інших правовласників, третіх осіб, та цієї Угоди.

3.4

Користувачеві заборонено самостійно або із залученням третіх осіб змінювати, копіювати, поширювати, повторно публікувати, завантажувати, розміщувати, декомпілювати або передавати будь-яким способом без попередньої письмової згоди Розробника контент, вебсторінки чи будь-яку інформацію, що розміщена на вебсайті grade-university.com.

3.5

Користувач несе особисту відповідальність за використання вебсайту grade-university.com будь-якими способами, прямо не дозволеними цією Угодою та/або законодавством.

3.6

Користувач не має права здійснювати будь-які несанкціоновані дії щодо роботи вебсайту grade-university.com.

3.7

Користувачеві надається можливість як безкоштовно, так і за плату у визначених розмірах, проходити Навчальні Курси та/або переглядати матеріали Відео бібліотеки, а також користуватися повним функціоналом/сервісами вебсайту grade-university.com.

3.8

Умови використання вебсайту grade-university.com можуть бути змінені та/або доповнені Розробником в односторонньому порядку. При цьому продовження використання вебсайту grade-university.com після внесення змін і/або таких доповнень, означає згоду Користувача з такими змінами та/або доповненнями.

3.9

Користувач посвідчує, шляхом приєднання до умов Угоди (в порядку передбаченому п.1.4.), що він знає (та усвідомлює факт) про включення персональних даних (особистої інформації) до бази персональних даних з метою реалізації цієї Угоди, забезпечення функціонування вебсайту grade-university.com та реалізації визначених законодавством прав та обов’язків у сфері реалізації цієї Угоди, а також отримав відомості про свої права, визначені Законом України «Про захист персональних даних», і про осіб, яким його дані надаються, для виконання зазначеної мети. Достатнім повідомленням Користувача про включення його персональних даних до бази даних — буде підтвердження реєстрації Користувача, або факт наявності дій, передбачених п.1.4. цієї Угоди.

3.10

Користувач надає згоду Розробникові здійснювати обробку його персональних даних для реалізації цієї Угоди, можливості/забезпечення Розробником функціонування вебсайту grade-university.com, поліпшення сервісу і збору статистики по ринку.

3.11

Користувач не має права розміщувати відомості (інформацію, дані), використовувати вебсайт grade-university.com, якщо він не згоден з умовами даної Угоди, або, якщо він не досяг встановленого законом віку, з якого він має право укладати правочини такого типу відповідно до законодавства. В такому разі Розробник пропонує припинити доступ та/або використання вебсайту grade-university.com.

4.1

Для виконання цієї Угоди можуть залучатися треті особи. Користувач підтверджує, що зазначеним третім особам надаються такі ж права, як і власникові прав на використання вебсайту grade-university.com, в тому числі щодо персональних даних Користувача.

• 4.1.1

  Відповідальність за грошові перекази, які здійснює Користувач, у зв’язку із використанням вебсайту grade-university.com, лежить на банках, фінансових установах, платіжних системах тощо, за допомогою яких здійснюються такі перекази. Розробник не несе відповідальності за дії процесингових центрів.

4.2

Користувач гарантує, що не буде робити будь-яких дій, спрямованих виключно на заподіяння шкоди Розробникові, правовласникам або іншим особам

4.3

В разі порушення правил використання вебсайту grade-university.com, обов’язків Користувача і заборон, зазначених у цій Угоді, а також в разі порушення пункту 5.2 цієї Угоди, Користувач зобов’язується відшкодувати Розробникові збитки, завдані такими діями в повному обсязі.

4.4

В разі накладення штрафів на Розробника у зв’язку з пред’явленням з боку третіх осіб претензій, пов’язаних з опублікованою Користувачем Інформацією і/або з порушенням Користувачем прав на об’єкти інтелектуальної власності, Користувач зобов’язується відшкодувати Розробнику всі збитки, включаючи судові витрати, зумовлені недотриманням положень цієї Угоди або порушенням прав третіх осіб.

4.5

Користувач несе повну особисту відповідальність за несанкціонований доступ третіх осіб до вебсайту grade-university.com, вхід на який здійснений за допомогою пристроїв Користувача.

4.6

В разі втрати, видалення, пошкодження внесеної Користувачем при використанні вебсайту grade-university.com інформації в результаті дій/бездіяльності Користувача, всю відповідальність несе Користувач.

4.7

Визнаючи міжнародний характер мережі Інтернет, Користувач приймає на себе відповідальність за дотримання всіх місцевих правил і законів (де Користувач має доступ та використовує вебсайт grade-university.com), що стосуються дій Користувача в мережі Інтернет.

У разі якщо використання вебсайту grade-university.com суперечить місцевим правилам і законам, Розробник пропонує припинити доступ та/або використання вебсайту grade-university.com.

4.8

Користувач вебсайту grade-university.com зобов’язується не виконувати дій, які можуть розглядатись як порушення законодавства України або норм міжнародного права, у тому числі у сфері інтелектуальної власності, авторських та/або суміжних прав, а також будь яких дій, які призводять або можуть призвести до порушення нормальної роботи вебсайту grade-university.com.

4.9

Розробник не несе відповідальність за відомості (інформацію, персональні дані), які Користувач розмістив при використанні вебсайту grade-university.com.

4.10

У зв’язку з тим, що вебсайт grade-university.com функціонує за допомогою мережі Інтернет, то Розробник знімає з себе відповідальність:

• за будь-які порушення роботи вебсайту grade-university.com;
• за будь-які помилки в роботі вебсайту grade-university.com;
• за заподіяння шкоди, збитку, втрату інформації чи за нанесення різної іншої шкоди особам, які виникли при користуванні функціоналом та сервісами вебсайту grade-university.com, у тому числі будь-які інші матеріальні втрати, понесені внаслідок відвідування вебсайту grade-university.com або неможливості його відвідування;
• за порушення Користувачем авторських (а також, суміжних прав, а також, інших прав майнових і немайнових прав суб’єктів права інтелектуальної власності) і інших прав третіх осіб, шляхом надання відомостей (інформації, даних), невідповідних чинному законодавству (в тому числі законодавству що регулює відносини у сфері інтелектуальної власності, як законодавства України так і міжнародного), в тому числі, наданої Користувачем при використанні вебсайту grade-university.com;
• за розміщення інформації зловмисниками, а саме розміщення відомостей (інформації, даних) із завідомо неправдивою інформацією.
